1.         Introduction  

HEAT EXCHANGE LLC (“HEAT EXCHANGE”, “we”, “us”, or “our”) operates the website located at https://Heat Exchanges.com/ , other related websites and mobile applications (collectively, the “Site”). This Privacy Policy explains HEAT EXCHANGE’s privacy practices that apply to the services (collectively, the “Services”) provided through the Site.

Please read the Privacy Policy carefully so that you can understand how HEAT EXCHANGE collects, uses, and discloses information and Data from and/or about you when you use the Site or the Services.

By using the Site you are consenting to the use and disclosure of your personal information as outlined in this Privacy Policy. You provide us, all in accordance with applicable laws, the phone numbers in your mobile address book on a regular basis, including those of both users of our services and all other contacts on your device.

We will not engage in any activity with Google Play or the Apple Itunes Store, including making our Products available via Google Play or Apple Itunes Store, that interferes with, disrupts, damages, or accesses in an unauthorized manner the devices, servers, networks, or other properties or services of any third party including, but not limited to, Google or any Authorized Provider. We may not use user information obtained via Google Play or the Apple Itunes Store to sell or distribute Products outside of Google Play or Apple Itunes.

2.         Personal Information 

We will only use your personal information as set forth in this Privacy Policy.

To provide services you will be asked to create an account. You will need a username and password to access that account. When you create your account HEAT EXCHANGE will ask for personal information. Personal information will not be collected without your entry onto the Site. Entering personal information onto our site is acquiescing to HEAT EXCHANGE’s privacy practices. We may collect or receive your personal information directly from you, or indirectly from you. Some forms of indirect collection are through your activity on our site and through our services, your browser, vendors, suppliers, and third party advertisers.

The Personal Information we collect or maintain may include:

  1. Your name, gender, age, address, email address, username, password, photographs, social media network account information, email account information, geographic location, government issued identification, and other registration information you choose to disclose in connection with your account;
  2. Information about the computer or mobile device you are using, such as what Internet browser you use, the kind of computer or mobile device you use, and other information about how you use the Site;
  3. Login credentials used from third party sites such as Facebook, Google, etc., if you choose to log in from the third party site;
  4. Import contacts from your cellular, mobile device, or tablet’s phone books contact list;
  5. Any information you input for your profile such as name associated with you profile, biography, description, user reviews, ratings, your favorites, followers, items sold, items purchased, items reviewed, items listed, number of items listed, comments posted, and information you decide to share via social media networks. PLEASE NOTE YOUR USER NAME AND PROFILE PICTURE ARE AVAILABLE TO THE PUBLIC WHEN YOU USE OUR SITE AND SERVICES.
  6. Device specific information such as the hardware model, operating system, app usage, debugging information, mobile network, and device identifiers.
  7. Location information from various technologies to determine location, time zone, IP address, GPS, Wi-Fi access points, and mobile towers.
  8. Log data and usage information which collects and tracks your activity on our site, time stamp logs of visits on our site and usage of our services, duration of visit, history of content clicked and interacted which includes advertisements and click stream information during your visit on our site and usage of our services.
  9. Cookies may be used to collect the date and time of your visit, browsing history, preferences, user name, password, log in credentials, relevant advertisements and click stream information.
  10. Anything transmitted during a Chat session on our site and through use of our services is stored in our system as a chat message. Any information you choose to share via Chat is NOT mined for information. It is stored separately.
  11. Other information you input into the Site or related Services.

Please Note: WHILE WE PROTECT ANY INFORMATION YOU ENTER ONTO OUR SITE THAT INFORMATION MAY BE PUBLISHED TO THE PUBLIC THROUGH THIRD PARTIES THROUGH OUR SITE AND SERVICES. THIS INFORMATION MAY BE AVAILABLE TO OTHER USERS AND THE GENERAL PUBLIC. PLEASE REVIEW THE INFORMATION YOU ENTER ONTO OUR SITE.

3.         Use and Disclosure of Personal Information

We may use your Personal Information for the following purposes (subject to applicable legal restrictions):

  13. To use any photograph you upload for advertisement purposes to promote our Site and Services;
  14. To use any photograph you upload along with your username for your participation in some Services on our Sites;
  15. To connect you with users from your phone’s contact list that are also using the Services;
  16. To connect you with users from your phones email address that are also using the app;
  17. To connect you to any Social media accounts and share with friends or the public;
  18. To post public information in connection with our site and services. The information shared includes your username, email address, photograph, location, contact number, and any information you list in your profile, Chat, or choose to share via social media networks;
  19. To fulfill any other purpose for which you provide us Personal Information; and
  20. For any other purpose for which you give us authorization.

We may communicate with you by email or in app notifications in connection with our Services. We may send you direct marketing communications and information about our Services that we consider of interest to you. In each communication we will provide an “opt out” or “unsubscribe” feature to stop the transmission of further communications of this nature. If you opt out or unsubscribe to these emails we reserve the right to send non-marketing and advertisement correspondences to notify you about transactions, your relationship with us, updates to our Privacy Policy and Terms of Use.

Your device information allows these functions in our app:

  1. To connect your contacts from your cellular, mobile device, or tablet when using the “Connect to Contacts” feature. This allows you to connect with other users from your phone contact list that are using our site and services.
  2. Show your location for users located near you that are using our site and services.
  3. Obtain internet connection status, make API calls, and send and retrieve data to and from our servers.
  4. To confirm internet connectivity for use of our site and services.
  5. Access your cellular, mobile device, or tablet’s camera and photo library to upload and send photos on your profile and in chat.
  6. To save photos to your cellular, mobile device, or tablet via storage or photo library.
  7. Use Power Manager Wake Locks to keep your cellular, mobile device, or tablet from screen dimming or sleeping.
  8. To access the Apple Itunes Store or Google Play store for in-app purchases.
  9. Permission to use voice-activation and microphone to input information in connection with the use of our site and services.

We may also disclose Personal Information that we collect or you provide as permitted or allowed by law, as follows:

  1. To contractors, service providers and other third parties we use to support our business and generate income;
  2. As required by law, regulation, subpoena, court order, legal process or government request;
  3. When we believe in good faith that disclosure is necessary to protect your safety or the safety of others, to protect our rights, to investigate fraud; and

This site contains links to other sites. HEAT EXCHANGE is not responsible for the privacy policies of any site linked to this website and not wholly owned and controlled by HEAT EXCHANGE, its affiliates and subsidiaries. We encourage users to be aware when you leave our Site to review any privacy policy of a non-HEAT EXCHANGE site.

7.         Non-personal Information Collected

We may collect non-personal information and data from your visit on our Site and use of our Services. HEAT EXCHANGE does not knowingly allow individuals under the age of 18 to create accounts that allow access to our Site or use the Services. Section 230(d) as amended, HEAT EXCHANGE hereby notifies you that parental control protections (such as computer hardware, software, or filtering services) are commercially available that may assist you in limiting access to material that may be harmful to minors.

NOTE: Any content contained in a chat message between users is stored as a chat message and not in your user profile or as a separate category of data. This may include certain categories of information listed above as “Not Collected.” For example, if you chat with another user about your age or education history, we do not store this data separately or use it for any purpose. We do not mine user chat messages for information and we do not share the content of our chat messages with any third parties and we do not use it for any purpose other than facilitating a chat service between users. 11.3 Sales of personal information

We respect your privacy and have never sold our users’ personal information as most people understand that term. Recent laws, such as the CCPA, provide California state residents various rights over their personal information and define terms like “sale” much more broadly than the common interpretation of the term. For example, sharing user IP addresses with advertising platforms in order to show relevant advertising, is now considered a “sale” under CCPA.

In the preceding twelve (12) months, as defined by the CCPA, HEAT EXCHANGE has “sold” (as defined in the CCPA) the following categories of personal information for a business purpose:

We are extending these Rights to all of our users in the United States and they are described above in more detail in Section 6. NEVADA

Nevada law permits residents of Nevada to opt-out of data sales by web operators. A “sale” under Nevada law means the exchange of personal identifiable information for monetary consideration to a person for that person to license or sell that personal identifiable information to additional persons. HEAT EXCHANGE does not sell your personal information under Nevada law. However, HEAT EXCHANGE is offering all of its users the right to opt out of the sale of personal information under the CCPA, which we believe contains a broader definition of “sale.”
